What Does This Bill Do?

  • Directs the Secretary of State to seek negotiations to rename Taiwan’s de facto embassy in the United States from the “Taipei Economic and Cultural Representative Office” (TECRO) to the “Taiwan Representative Office” (TRO). 
  • If the renaming is implemented, all U.S. government documents, laws, maps, and records referring to TECRO would be updated to TRO.
  • Stipulates that it shall be the U.S. policy, consistent with the “Taiwan Relations Act” and the “Six Assurances,” to provide the people of Taiwan with “de facto diplomatic treatment” equivalent to foreign countries, nations, states, governments, or similar entities.

Former Senator Marco Rubio (R-FL), now U.S. Secretary of State, has been a leading champion of the effort to rename TECRO as the “Taiwan Representative Office” and had repeatedly introduced the legislation since 2022.

Why Is It Important?

From early Congressional support letters to current standalone legislation, FAPA has advocated for the name “Taiwan” to be clearly and accurately recognized in U.S. policy and official practice for more than two decades because names carry profound policy meaning. Taiwan’s de facto embassy in the United States is currently named the Taipei Economic and Cultural Representative Office (TECRO). This name misrepresents Taiwan by implying the office only represents the city of Taipei and by reducing the scope of U.S.–Taiwan relations to “economic and cultural” affairs. In reality, the partnership is far broader, encompassing security, technology, health, and democratic cooperation. By contrast, longstanding U.S. policy consistently refers to Taiwan simply as “Taiwan,” as reflected in the Taiwan Relations Act, the Taiwan Travel Act, and the name of the U.S. de facto embassy in Taiwan — the American Institute in Taiwan (AIT). 

There is also precedent for renaming Taiwan’s representative office. Following the Taiwan Policy Review in 1994, the office was renamed from the oddly named “Coordination Council for North American Affairs [CCNAA] Office” to TECRO. More recently, in 2019, the CCNAA headquarters in Taipei was renamed the Taiwan Council for U.S. Affairs (TCUSA), explicitly using “Taiwan.”

Renaming TECRO to the Taiwan Representative Office (TRO) would build on this trajectory and facilitate further alignment with existing U.S. policy and practice. It would underscore America’s commitment to Taiwan’s democracy, strengthen U.S. credibility, counter Chinese coercion, and signal to the world the strength of U.S. support for Taiwan.

What Is It Important?

The PORCUPINE Act supports Taiwan by:

  • Designates Taiwan as a “NATO-Plus” partner — a group that includes Japan, South Korea, Israel, Australia, and New Zealand — streamlining the arms delivery process by enabling shorter Congressional notification periods and higher weapons value thresholds under the Arms Export Control Act.
  • Requires the Secretary of State to establish an expedited decision-making process for third-party transfers of U.S.-made defense articles and services from NATO and NATO-Plus countries to Taiwan.


Background

Taiwan’s Arms Backlog

China has intensified military pressure on Taiwan with increasingly frequent “gray-zone” incursions. In 2024, Taiwan’s Ministry of Defense recorded 3,070 PLA sorties across the Strait’s median line — more than triple the 2021 figure. Meanwhile, the Chinese Coast Guard expanded operations east of Taiwan, and the PLA Navy carried out large-scale exercises. These actions violate international norms, destabilize the region, and make the prospect of invasion or blockade increasingly plausible. Yet Taiwan’s self-defense remains constrained by a $32 billion U.S. arms backlog as of December 2025.

Recognizing Taiwan’s role in maintaining peace and prosperity in the Indo-Pacific, Members of Congress have proposed granting it “NATO Plus” status through an amendment of the Arms Export Control Act (AECA) — placing Taiwan alongside trusted partners such as Japan, South Korea, Israel, Australia, and New Zealand. The bipartisan U.S.–China Economic and Security Review Commission (USCC) has also recommended this policy.

Granting Taiwan this status would:

  • Streamline arms sales, ensuring faster delivery of defense capabilities;
  • Deepen U.S.–Taiwan security ties, underscoring U.S. commitment;
  • Bolster regional peace and stability by countering Beijing’s coercion.

Adding Taiwan to “NATO Plus” is not only about arms delivery — it strengthens deterrence and reaffirms Taiwan as a trusted partner, safeguarding our shared democratic values against growing challenges.32

What Does This Bill Do?

Why Is It Important?

The current U.S. policy toward Taiwan is guided by the Taiwan Relations Act and the Six Assurances. The Six Assurances constitute the U.S.’s continuing promises to Taiwan.

They are that the United States: 

  1. Has not agreed to set a date for ending arms sales to Taiwan;
  2. Has not agreed to consult with the PRC on arms sales to Taiwan;
  3. Will not play mediation role between Taipei and Beijing;
  4. Has not agreed to revise the Taiwan Relations Act;
  5. Has not altered its position regarding sovereignty over Taiwan; and
  6. Will not exert pressure on Taiwan to enter into negotiations with the PRC [People’s Republic of China].

Since the Reagan administration, every President has maintained the Taiwan Relations Act and the Six Assurances, contributing vitally to peace across the Taiwan Strait. Nevertheless, unlike the Taiwan Relations Act, the Six Assurances are not statutory U.S. law. Congress has the opportunity to solidify our commitments to Taiwan and strengthen U.S.-Taiwan relations by formally defining and codifying the Six Assurances.

What the Bills Accomplish

PORCUPINE Act (S.1744)

 

  • Designates Taiwan as a “NATO-Plus” partner — a group that includes Japan, South Korea, Israel, Australia, and New Zealand — streamlining the arms delivery process by enabling shorter Congressional notification periods and higher weapons value thresholds under the Arms Export Control Act.
  • Requires the Secretary of State to establish an expedited decision-making process for third-party transfers of U.S.-made defense articles and services from NATO and NATO-Plus countries to Taiwan.

Taiwan International Solidarity Act (S.2224)

 

  • Clarifies that the United Nations General Assembly (UNGA) Resolution 2758 did not address Taiwan’s territorial sovereignty and international representation, nor did it determine the relationship between the People’s Republic of China (PRC) and Taiwan. 
  • Urges the U.S. to proactively challenge the PRC’s misrepresentation of UNGA Resolution 2758 as a sovereignty claim over Taiwan and to encourage U.S. allies to resist China’s efforts to diplomatically isolate Taiwan.
  • Requires the U.S. to oppose any attempts by the PRC to “resolve Taiwan’s status by distorting the decisions, language, policies, or procedures” of international organizations. 
  • Emphasizing that the U.S. opposes any initiative to change Taiwan’s status without the consent of the Taiwanese people. 


Why are they Important?

China’s International Influence

On October 25, 1971, the UN General Assembly (UNGA) adopted Resolution 2758, recognizing the PRC as “the only lawful representatives of China.” The resolution never mentioned Taiwan. Yet, Beijing has mischaracterized it to advance its fictitious “One China principle,” claiming Taiwan as part of the PRC and using it to justify aggression and exclude Taiwan’s international participation.

China’s campaign to isolate Taiwan has undermined global security, public health, and governance. Taiwan, by contrast, has proven to be a reliable partner and a valuable contributor to the international community. Preserving Taiwan and its democratic institutions is essential to maintaining peace and stability in the Taiwan Strait and the Indo-Pacific. This serves the shared interests of Taiwan, the United States, and the international community.

Standing with Taiwan and pushing back against Beijing’s manipulation of international institutions sends a clear message: the U.S. will not tolerate coercion or allow China to rewrite global norms.

Why Is It Important?

The U.S. and Taiwan share deep and expanding financial and trade ties, advancing American interests and creating economic opportunities and jobs across the United States. In 2024, Taiwan ranked as the U.S.’s seventh-largest trading partner, while the U.S. remained Taiwan’s second-largest trading partner.

Despite this strong economic relationship, Taiwan remains the only top-ten U.S. trading partner without a bilateral tax agreement with the United States. The current double taxation scheme imposes financial burdens and higher tax rates on American and Taiwanese workers and businesses operating across our borders, discouraging investment and trade between the two countries.

Relieving double taxation and providing treaty-like tax benefits will support American and Taiwanese workers and businesses operating in each other’s countries while strengthening U.S.-Taiwan trade and economic ties. Eliminating double-tax disincentives will also encourage greater Taiwanese investment in the U.S., which is especially critical as we revitalize semiconductor manufacturing in the United States.

As a key U.S. economic and strategic partner that shares our democratic values, Taiwan plays a crucial role in our efforts to secure supply chains, reduce reliance on adversarial sources, and maintain regional stability — all of which are vital to the American economy and national security.

What Does This Bill Do?

  • Urge the U.S. to establish normal diplomatic relations with Taiwan
  • Call for an end to the outdated, counter-productive, and dishonest U.S. “One China Policy”
  • Negotiate a bilateral U.S.-Taiwan free trade agreement (FTA)
  • Support Taiwan’s full membership in international organizations


Why Is It Important?

The “One China policy,” established in the 1970s, no longer aligns with America’s current economic and security imperatives. By modernizing our policy and establishing a U.S.-Taiwan free trade agreement, we can secure American economic interests, reduce dependency on adversarial sources, and strengthen our strategic position in the Indo-Pacific region.

Today, the U.S. maintains normal diplomatic relations with nearly every country in the world, except for Syria, North Korea, Iran, Bhutan, and Taiwan. Considering that Taiwan is a key U.S. geopolitical ally in the first island chain, a full-fledged democracy, and among the U.S.’ top ten trading partners, we should conduct another Taiwan policy review and normalize U.S. relations with Taiwan.

This resolution urges the U.S. President to abandon the antiquated “One China Policy” and establish formal diplomatic ties with Taiwan, recognizing the objective reality that Taiwan is an independent country, neither governed by nor part of the People’s Republic of China.

It also calls for the U.S. to support Taiwan’s full membership in all international organizations and negotiate a U.S.-Taiwan free trade agreement.

On July 25, 2023, the House of Representatives unanimously passed an identical bill (H.R. 1176). The Senate should follow suit and swiftly pass this crucial legislation.


What Does This Bill Do?

  • The Taiwan International Solidarity Act clarifies that the 1971 United Nations General Assembly (UNGA) Resolution 2758 did not address the issues of Taiwan’s territorial sovereignty and international representation, nor did the resolution determine the relationship between the People’s Republic of China (PRC) and Taiwan. 
  • This Act urges the United States to more proactively challenge the PRC’s fabricated sovereignty claim over Taiwan, and also encourage U.S. allies to oppose China’s efforts to undermine Taiwan’s international relations.
  • It requires the U.S. to oppose any attempts by the PRC to “resolve Taiwan’s status by distorting the decisions, language, policies, or procedures” of international organizations. 
  • It also emphasizes that the U.S. “opposes any initiative that seeks to change Taiwan’s status without the consent of the [Taiwanese] people.”

Thank Your Members of Congress for Foreign Aid to Taiwan!

On April 23, the Senate overwhelmingly passed a $95 billion foreign aid package on emergency appropriations, including provisions to “divest or ban” TikTok. The next day, April 24, President Biden signed the bill into law.


What Does This Bill Do?

 
  • The package allocates US$8.1 billion for Indo-Pacific security, including US$2 billion in foreign military financing for Taiwan and other key allies in the region;
  • This Act provides US$1.9 billion to replenish defense articles and defense services provided to Taiwan and regional partners;
  • This Act includes US$542 million to strengthen U.S. military capabilities in the region.
